Meta Says Humans Made the Layoff Calls. 26 Ex-Staff Say the AI Did. Now It’s in Court.

Twenty-six current and former Meta employees are suing the company, alleging its latest layoffs leaned on AI in a way that discriminated against workers with disabilities and those who had taken medical or parental leave. The complaint, filed in federal court in Oakland, claims Meta used internal AI systems, keystroke and activity monitoring, “AI token-usage dashboards” and algorithmically assisted performance rankings to decide who got cut. Meta’s response is a flat denial: “Workforce management and organizational decisions were and are made by people, not AI.”

Somebody is wrong, and the discovery process is going to be fascinating. Because here is the thing: the two claims are not as far apart as they sound. “A human made the final call” and “an AI system ranked, flagged and shortlisted the people that human chose from” can both be true at once, and that grey zone is exactly where this case, and a coming wave like it, will be fought.

Why this is bigger than Meta

This is one of the first serious tests of a question every large employer now faces: when you feed staff data into an algorithm and it shapes who gets fired, who is legally responsible for the outcome? If the AI’s rankings correlate with protected characteristics, saying “but a manager signed off” may not be much of a shield. Employment lawyers are watching because the answer will set the rules for algorithmic management everywhere, not just at Meta.

The context does not flatter Meta. This is the same round in which it cut around 8,000 people, some reportedly waking to 4am termination emails, while reassigning thousands more to train AI models. Whatever the court finds, the optics, using AI-adjacent tooling to trim the workforce so you can build more AI, are grim, and the viral ex-employee posts have made sure everyone noticed. The lesson for other companies is blunt: if you let an algorithm anywhere near a firing decision, assume you will one day have to explain exactly what it did, under oath.
